MenacGifts ("we", "us", "our") is an intermediary gift delivery service operating from Nigeria. When you place an order, we procure the requested item(s) from a third-party retailer or supplier on your behalf and arrange delivery to a recipient specified by you.

We are not the manufacturer, original retailer, or brand owner of any product. Our service is the procurement, packaging, and logistics coordination — not the production of goods.

Our service is primarily intended for customers in Nigeria sending gifts to recipients locally or internationally.

Our service involves two distinct parties. Understanding each role is important:

• ✦The Sender is the person who places and pays for the order on our website. The Sender is our customer and the sole party bound by these Terms & Conditions. All communications, confirmations, and refund rights apply to the Sender only.
• ✦The Recipient is the person to whom the gift is delivered. The Recipient has no contractual relationship with Menac Gifts and has no rights or claims against us under these terms.
• ✦By placing an order, the Sender confirms they have the right, authority, and permission to send goods to the specified Recipient at the specified address.
• ✦The Sender is solely responsible for ensuring the Recipient is willing and able to receive the delivery at the given address and time. We are not liable for failed deliveries due to recipient unavailability, refusal, or restricted access.
• ✦All delivery notifications, tracking updates, and order confirmations will be sent to the Sender's contact details, not the Recipient's, unless otherwise requested.
• ✦The Sender is responsible for any re-delivery costs arising from the Recipient being unavailable, refusing delivery, or providing an inaccessible address.
• ✦If a delivery is returned to us or our logistics partner due to Recipient-side issues, the Sender will be contacted. Reshipping costs are borne by the Sender. If unclaimed after 14 days, the order may be forfeited without refund.

The price you pay on MenacGifts includes the cost of the product(s), applicable shipping and logistics fees, customs duties where relevant, packaging, and our service fee. We do not separately disclose the cost breakdown of each component.

• ✦Prices displayed on our website are subject to change at any time without prior notice, including after an order has been placed but before payment is confirmed.
• ✦In the event that a product's procurement cost increases significantly after your order is placed, we reserve the right to contact you for a price adjustment or cancel the order with a full refund.
• ✦Exchange rate fluctuations may affect pricing. The final charge is based on the exchange rate at the time of payment confirmation.
• ✦Any quoted price is an estimate until payment is fully confirmed and the order is accepted by us in writing (email or chat).

All products are subject to availability from our third-party suppliers at the time of procurement. Listing a product on our website does not guarantee it is in stock or available at the time of your order.

• ✦If a product becomes unavailable after your order is placed, we will notify you promptly or offer a suitable alternative or a full refund.
• ✦Product images, descriptions, and specifications are sourced from third parties and may not always reflect the exact item received. Minor variations in colour, packaging, or appearance are possible.
• ✦We reserve the right to substitute a product with one of equal or greater value if the original is unavailable.

Delivery timelines provided on our website and at checkout are estimates only — they are not guaranteed delivery dates. Actual delivery times may vary due to factors beyond our control.

• ✦Same-day delivery is subject to order confirmation, payment clearance, and the availability of a delivery partner in the recipient's area. We do not guarantee same-day delivery where conditions cannot be met.
• ✦International deliveries (7–21 business days) may be delayed by customs inspections, import regulations, public holidays, or courier backlogs. We are not liable for delays caused by customs authorities or border agencies.
• ✦MenacGifts is not liable for any loss, cost, or damage arising from delivery delays, including missed occasions such as birthdays, anniversaries, or holidays.
• ✦Once a package is handed to a courier or third-party logistics provider, responsibility for the package transfers to that provider. We will assist in tracking and escalating lost parcels but cannot guarantee outcomes.
• ✦Incorrect or incomplete delivery addresses provided by the customer may result in failed delivery. Re-delivery charges will be borne by the customer.

Placing an order on MenacGifts constitutes an offer to purchase. An order is only accepted and confirmed once we send you a written confirmation via email or chat.

• ✦We reserve the right to cancel or refuse any order at our sole discretion, including but not limited to cases of pricing errors, product unavailability, suspected fraud, or inability to fulfil delivery.
• ✦If we cancel an order after payment, a full refund will be issued within 5–10 business days.
• ✦Customer-initiated cancellations are accepted within 2 hours of order placement, provided the order has not yet been processed. After this window, cancellations may not be possible.
• ✦Once an order has been dispatched, it cannot be cancelled.

As an intermediary service, our ability to process returns is subject to the return policy of the original third-party retailer or supplier from which the product was procured. We will make reasonable efforts to facilitate a return or refund where the supplier's policy permits.

• ✦Refunds are considered for items that arrive damaged, defective, or significantly different from what was ordered. Photo evidence must be provided within 48 hours of delivery.
• ✗We do not accept returns or offer refunds for perishable items, food products, or consumables once delivered, unless the item is demonstrably unfit for consumption upon arrival.
• ✗Change-of-mind returns are not accepted once an order has been processed.
• ✦Where a refund is approved, it will be processed to the original payment method within 5–10 business days. Shipping costs are non-refundable unless the return is due to our error.
• ✦MenacGifts is not responsible for costs incurred in returning items internationally.

MenacGifts shall not be liable for any failure or delay in fulfilling an order caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government restrictions, strikes, civil unrest, war, customs embargo, fire, flooding, power outages, or internet/platform outages affecting our suppliers.

In such events, we will notify you as soon as reasonably possible and offer a revised delivery estimate, an alternative, or a full refund at our discretion.

MenacGifts sources products from independent third-party retailers and platforms. We are not affiliated with, endorsed by, or agents of these platforms. Their own terms, conditions, and policies govern the sale of their products.

• ✦We are not responsible for the accuracy, completeness, or legality of product listings on third-party platforms.
• ✦Product warranties (if any) are those of the original manufacturer. We do not offer any additional warranty on products.
• ✦Our website may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites.

For international deliveries, the recipient's country may impose import duties, taxes, or customs fees. These charges are not included in our shipping cost unless expressly stated at checkout.

• ✦The customer and/or recipient is solely responsible for any applicable customs duties, import taxes, or inspection fees levied by the destination country.
• ✦Menac Gifts is not responsible for packages delayed or seized by customs authorities. We will provide documentation to assist clearance where possible.
• ✦It is the customer's responsibility to ensure the ordered items are legal to import into the recipient's country. We accept no liability for prohibited items.

We collect personal information from the Sender (name, address, email, phone number) solely for the purpose of fulfilling your order. We do not sell or share your data with third parties for marketing purposes.

• ✦By providing a Recipient's personal details (name, address, phone number) to Menac Gifts, the Sender confirms they have the Recipient's knowledge and/or consent to share this information with us for the purpose of completing the delivery.
• ✦The Sender accepts full responsibility for the accuracy and legality of any personal data submitted about the Recipient. Menac Gifts is not liable for any privacy complaint, claim, or dispute arising from a Sender sharing a Recipient's data without their consent.
• ✦Recipient information will be shared with our courier and logistics partners strictly for delivery purposes and will not be retained beyond what is operationally or legally required.
• ✦The Sender's contact details are used for order updates, confirmations, and support. We do not contact the Recipient directly unless operationally necessary for delivery completion.

These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from the use of our service shall be subject to the exclusive jurisdiction of the courts of Nigeria.

Before escalating any dispute, we encourage customers to contact our support team. We will make every reasonable effort to resolve complaints fairly and promptly within 14 business days.

We reserve the right to update or modify these Terms and Conditions at any time. Changes take effect immediately upon publication on our website. Continued use of our service after any change constitutes your acceptance of the new terms.
